Terms of Use

Please find below the Terms and Conditions set out by iVisa Consulting Inc., which are governed by the laws of the Philippines.

iVisa Consulting Inc. will process an application to the client's requirements and requests and will not be responsible for any incorrect information provided. iVisa Consulting Inc. will make all efforts to obtain the correct document or visa in the specified period of time. However, iVisa Consulting Inc. will not be responsible for any of the following events occurring with the issuing authority; refusal to issue the visa, refusal to accept the application, issuance of an incorrect visa, delay in processing the visa.

Should iVisa Consulting Inc. have caused any of the above through error or omission, then iVisa Consulting Inc. is not liable to any cost of a replacement visa or refund of all government fees paid. iVisa Consulting Inc. cannot accept any responsibility for consequential loss, such as but not limited to lost profits/income, lost hotel, and airfares.

Account Cancellation and Termination

In the event, that we find your information is anomalous and/or you are related or accessory to any unlawful acts, illegal practices, malpractices, part of terrorism group and personalities, and any other association and/or associated (with) to unlawful/illegal identities; iVisa Consulting Inc. has the right to immediately refuse not to do business with you.
In cases that initial process of the application has taken place and you wish not to proceed to process your visa application, you are not entitled to a refund. However, iVisa Consulting Inc. will hold your case/application for a maximum of 6 months from the time of notification. Your payment is considered forfeited beyond the 6 months period.
iVisa Consulting Inc. maintains professionalism in all aspects and dealings with clients. For cases that you become unreasonably difficult, uncooperative, and display unprofessional acts such as any forms of harassment and other forms of misconduct to any of our team members and system, iVisa Consulting Inc. has the right to immediately terminate the processing of your application without any refund of the service/professional fee.
You may cancel your application within 24-hour period beginning from the time of email confirmation of your payment is received by iVisa Consulting Inc. and an admin fee of Php 3,000 or 15% whichever is higher will be deducted from the total service fee. If we have initiated work on your application and/or provided you the tailored list of documents within the 24-hour period, then you are liable for the full amount of service fee.
For applications canceled after a 24-hour period, ONLY GOVERNMENT FEES will be refunded. The SERVICE FEE and its corresponding Government Tax will NOT be refunded. You will NOT be refunded of any Government fees in the event that iVisa Consulting Inc. have already made payment/s. A transaction receipt will be provided for any Government fees that have taken place.
Processing time, documents, services and visas quoted by iVisa Consulting Inc. are approximate and based on processing times provided by Embassies or Consulates under normal circumstances.
In an industry as complex as global immigration, it would be misleading to offer guaranteed processing times. Although we endeavour to always try and meet our customer’s needs and requests, there may, from time to time, delays. Because of this, processing times quoted are offered in the context of expected rather than guaranteed times, on the understanding, there may be occasional delays caused by unforeseeable circumstances. The duration of the visa and the number of entries will be determined by the issuing authority.
Embassies or Consulates may request additional documents and may delay processing at their discretion without further explanations. iVisa Consulting Inc. will not be held responsible for any delays, cancellations, financial and other losses due to denial or delay in processing of the embassies or consulates. No service fees, service taxes, courier fees, shipping charges or any portion thereof will be refunded.
You may receive refunds in cases where we are unable to provide you with the service as stated in the contract.

Availability and Pricing

iVisa Consulting Inc. is not responsible in the event you fail to receive your documents, visa or any other service requested by you. We do not guarantee in any way that your application will be accepted or granted by the immigration authorities. Our service has been fulfilled once we arranged the submission of the application to the relevant immigration authorities.
Every applicant is responsible for conforming with and fulfilling any requirements stated by the immigration authorities.
iVisa Consulting Inc. will not accept responsibility if an applicant is not eligible for the services requested, for incorrect/incomplete information provided by the applicant, for failure to provide supporting documents as and when required, or for any similar errors in relation to Immigration or Visa application.
iVisa Consulting Inc. does not issue documents or visas and is not affiliated to or part of any official or government body, including the embassies.
Applications for documents, services or visa’s and all other related services may be made directly to the governing authority.
If there should be a change in the pricing of a given service or product requested by an applicant then management shall review that, if additional costs are required then the applicant will be liable to settle to disbursement, alternatively if there is a decrease then management may decide to refund any such difference.
All prices are inclusive of appropriate taxes.
In certain cases, documentation, services or Visa fees include 3rd party charges
Requirements and fees related to the processing of documents, services and visas and other services offered by iVisa Consulting Inc. are subject to change without prior notice.
Application forms and additional documents required for documents, services and visas issuance are subject to change without notice.
Embassy or Consulate Officials may request additional documentation at their discretion. They may also decline the issuance of visas without disclosing the reason for denial.
iVisa Consulting Inc. reserves the right to decline processing of documents, services or visas for any reason, including but not limited to incomplete documentation, insufficient processing time, or unusual circumstances.
If your application includes translations these will be translated by a sworn and certified translator. The client will be informed of any translations required and will be responsible for the fees involved.
If your application includes return courier of your passport you will be contacted before this is sent to confirm the address, deliveries within the Philippines. You will be responsible for any fees involved if the service you avail with us does not include the courier fees.
You are deprived of any right to go to any court of law against us in connection with any services made by us legally. If by any means, the jurisdiction lies in the Philippines only. Any loss of passport(s) and other documents, if any, will not be either held responsible or the liability of the iVisa Consulting Inc. services.
Any request of refunds will be processed within 30 days from the time of request. Any amount will be refunded to your designated bank or to the debit/credit card used when payment was made to our site.
If you do not agree to be bound by and comply with these Terms of use, please do not access or use this site.

LIMITS ON USE

You may not use this site or the services offered on or through it for personal gain and you may not sell or provide to any third party, or otherwise profit from, any services or information (nor any modification, adaptation or analysis of them) available on or through this site.

SECURITY

We reserve the right from time to time to (a) alter and/or introduce new and/or additional security measures without notice; (b) temporarily withdraw and/or limit the availability of this site to any individual(s), and (c) do anything else that we believe necessary to preserve the security and integrity of this site and the information held in this site's databases.

ACCURACY & SITE CONTENT

We use reasonable skills and care in compiling the information accessible on and through this site. However, certain information may have been compiled and/or provided to us by a third party who is not a member of our network. iVisa Consulting Inc. does not accept responsibility for the accuracy of any information which is obtained from any such third party. Furthermore, errors and omissions in the information accessible on and through this site may occur because of a number of factors that are inherent in any internet-related system and which are not within our reasonable control. For example, information may be affected by machine, software or operator error, or malfunctions in connection with data transmission. In view of this, the information is provided "as is" and you should always attempt to verify the accuracy of any information obtained from this site before relying upon it. This is a dynamic site and as a result, the content and look and feel may change from time to time without prior notice.

LIMITED LICENCE & OWNERSHIP

You are granted a limited license to download the materials contained on this site to a personal computer, and to print a hard copy of such materials, solely for your personal, non-commercial use, provided that all copyright, trademark and other proprietary notices are left intact. Save as expressly and specifically permitted in these Terms of use, all translation, re-transmission, distribution, or other use of the materials contained on this site and in its databases on any other internet site or other media is strictly prohibited.

You are also prohibited from:

(a) framing this site or any part of it on any other site; or

(b) mirroring this site on another server; or

The grant of this limited license is conditional upon your agreement to and compliance with all of these Terms of use. (a) contact you and provide you with information (as requested), and

(b) deal with any other matters arising as a result of that contact. \

Subject to the provisions of applicable law and for a small fee you may obtain a copy of the User Data (if any) we hold about you by contacting us via the sites "contact us" facility. Additionally, if you wish to delete, deactivate or amend the User Data, or find out what User Data (if any) we are holding about you, please contact us via the sites "contact us" facility.

We will not sell the User Data to anyone. We will not disclose the User Data outside iVisa Consulting Inc. except as necessary to deal with matters arising from your use of the site and your contact(s) with us, or in the unlikely event that we believe in good faith that we are required to do so:

This site does not utilise cookies. Your Consent by using this site you consent to iVisa Consulting Inc. processing and transferring the User Data as necessary for us to provide you with and enable you to use the site and for the purposes referred to above.

(c) Subject to paragraph (d) below, but otherwise so far as permitted by law, our total aggregate liability hereunder in respect of direct loss and damage and other direct liability, howsoever arising, whether, in contract, tort (including negligence), statute or otherwise shall be limited per claim or series of related claims, to Php100.

(d) Nothing in these Terms of use shall limit our liability for (i) loss or damage for death or personal injury caused by our negligence; or (ii) for any fraudulent misrepresentation made by us or those under our control.

(e) If you are using this site as a consumer then nothing in these Terms of use shall in any way limit your statutory rights.

SEVERABILITY

If one or more of the provisions of these Terms of use are at any time found to be invalid by a court, tribunal, or another forum of competent jurisdiction, or otherwise rendered unenforceable, that decision shall not invalidate or void the remainder of these Terms of use. These Terms of use shall be deemed amended by modifying or severing such provisions as necessary to render them valid, legal and enforceable while preserving their intent, or if that is not possible, by substituting another provision that is valid, legal and enforceable which materially gives effect to their intent. These Terms of use supersede all prior agreements, arrangements, and statements (except for those for which liability is not excluded) between us with respect to your use of this site and constitute the entire agreement between us.

CHANGE OF TERMS OF USE

We may alter, adapt or otherwise change these Terms of use from time to time (for security, legal or regulatory reasons, or to reflect updates or changes to the services or functionality of the site) without prior notice. No one other than you and us will have any right under the Contracts to enforce any term of these Terms of use, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this clause shall affect the rights of any permitted assignee or transferee.

GOVERNING LAW

Use of this site and the Service is governed by the Philippine laws, and you irrevocably agree to submit any claim or dispute arising in relation to, out of, or in connection with this site (and any use you make of it or the Service and/or opportunities offered through it) to the non-exclusive jurisdiction of the Philippine courts.

PASSPORT, IMMIGRATION AND VISA

You must consult the relevant Embassy or Consulate for this information. Requirements may change and you should check for up-to-date information in good time before departure. We regret we can accept no liability if you are refused entry onto the flight or into any country due to failure on your part to carry the correct passport, Immigration or Visa or other documents required by any airline, authority or country.

Health: Recommended inoculations for travel may change at any time and you should consult your doctor on current recommendations before you depart. It is your responsibility to ensure that you obtain all recommended medication and follow all medical advice in relation to your trip.

We are not responsible nor liable for the behaviour or actions of the applicant at any stage or in any country that they may travel to.

The Immigration or Visa processing time mentioned on the website is indicative & authorities might take some extra time which is beyond our control.

The User's use of the Website and or the Offered Service is on the strict understanding that the Website and or the Offered Service is not engaged in rendering advice and should not be relied upon when making any related travel or other decision.
